A new twist on the CC license

Dan Gilmor, author of the journalism textbook/website Mediactive, has recently come up with a new concept for licensing his textbook.

Mediactive is usually available under a CC license, but Dan has recently decided to start offering a site license to schools of journalism. It might sound odd that he doesn’t want to give it away to everyone, but his reasoning makes a certain amount of sense.

As he sees it, the schools of journalism are actually in the business of selling seats in the classroom. They charge tuition, don’t they? If you go along with his interpretation then it’s clear that the schools can’t use his CC licensed textbook without violating the non-commercial clause.

That’s a fascinating interpretation, isn’t it? Do you think he’s right?
